  • Question: A listener has a question. They were living with their parents in an apartment located in west Kissimmee. The apartment complex has been falling apart and there’s a bunch of bats. Both parents have COPD and the guano from the bats.
  • Answer: If you live in a place that is unsafe and causing you to be sick, they might have a duty to take care of the issues, if they are aware of the situation. If you have injuries caused by someone else’s negligence and they are significant, you should contact an attorney and see if they can help you.

  • Question: If the COPD was pre-existing before this situation presented itself, and the bat guano exasperated, could they have a case?
  • Answer: If it contributed to making the situation worse then you may have a case.
  • Question: I hurt my back approximately 6 months ago and the worker’s comp has been taking a long time. I finally go for an injection on my back next month. What are my options?
  • Answer: You normally can go through workers comp. If the delays are still going on, contact my office and we will put you in the right direction.
  • Question: Can an employer get away with not paying you overtime pay and only paying straight pay for over 40 hours because they pay it in cash off the books?
  • Answer: Off the books is a federal crime. Don’t let anybody pay you off the books. Employers pay off the books, so they don’t have to pay for the things that protects you.
  • Question: I was injured at work with bad burns and was airlifted to ORMC. The company does not have workers’ comp. Are there grounds for a law suit?
  • Answer: If something happened to you on the job and they don’t have workers’ comp, they might still be held responsible.
  • Question: I got backed into, in a parking lot as we were both backing out. It was a minor fender bender. I was in drive already to head forward when she hit me. She filed a claim with her insurance, but I didn’t have enough damage to file with mine. Will it affect my rate and is there anything else I need to do?
  • Answer: It can affect your rate if they find that you are at fault for it.
